THE MARKET
Location
and Time
• The
first EP Farmers Market will be held at the Eyre Peninsula Field Day
site as part of the EP Field Days.
• The
market promotes sustainable agriculture by giving priority to biodynamic
and organic produce.
• Future
EP Farmers Markets will be determined by demand.
Products
to be sold
• All products sold must be produced, caught, grown or raised
on the Eyre Peninsula or manufactured by the stallholder primarily
from produce grown on the Eyre Peninsula.
• This
is a food only market – the only exceptions are potted plants,
cut flowers, compost and wood.
• Genetically
engineered foods (including animals knowingly raised on GE feed) cannot
be sold at the market.
Products eligible for sale include:
There are two
different types of stalls; fresh fruit and vegetables (including eggs)
and value added products (olive oil, preserves, baked goods, potted
plants etc.) Whichever type of product makes up over 50% of the stall
determines its type.
Category
1 - Primary farm produce
• Includes
eggs, fruit, vegetables, herbs, olives, meat, fish, seafood, cheese,
milk, butter, ice cream, flour, nuts, grains, honey and bee products,
fruit juices, potted herbs.
• The
produce must have been reared or grown by the producer/business named
on the application form and have spent at least 50% of its life on
the Eyre Peninsula.
Category
2 – Value-added consumable products
• Includes
products such as oils, wine, jams, preserves, breads, cakes, and desserts
which are based on locally grown content.
• This
market does not permit the purchasing/re-packaging/selling on of finished
or imported goods.
• The
stallholder may sell only products listed on the approved application
form.
• If
stallholders have additional produce available to sell during the
season, the Market Coordinators must approve this. Stallholders must
give 24 hours notice, in writing, via email, fax or mail, of intention
to vary the produce originally nominated on the application form.
SITE
AND STALLHOLDER REQUIREMENTS
Cleanup and Rubbish
• All
stallholders must ensure that their stall site and the area that surrounds
it is left in a clean and tidy state once the market closes each day.
Failure of this requirement will result in the permit to trade being
revoked.
Health
and Safety
• Stallholders
must confine displays and signs to the stall site and keep pathways
clear for shoppers.
• Smoking
by stallholders is not permitted.
• Dogs
are not permitted.
• All
food stallholders must trade in accordance with the Health Department
of South Australia’s food-handling regulations, and other relevant
local health laws.
Labelling
& Signage
• All
stallholders will be expected to comply with the minimum requirements
of current trading standards regulations regarding labelling and descriptions
of goods.
• All
organic produce must be certified by the relevant accrediting body
(e.g. NASAA, BDF) and be labelled “certified organic.”
Evidence of accreditation must be provided upon application.
• All
prices (per kilo or per item) must be clearly visible.
• Each
stallholder must display a sign showing their name and address every
day they attend the market.
Presentation
• Stallholders
will be expected to be neat, suitably dressed and deal with the public
in a courteous manner.
• Products
should be displayed attractively, with due regard for consumers and
other stallholders.
• Tastings
of products are strongly recommended.
Quality
of produce
• Produce
should be picked as close to market time as possible and handled in
a way to preserve the fresh quality until market opens.
• Stallholders
must guarantee against selling “unmarketable” produce.
• Stallholders
in breach of the charter will be required to withdraw produce.
• Genetically
modified produce will not be permitted
Setting
Prices
• Selling
in direct competition, for example; price under-cutting of other stallholders,
is not in keeping with the spirit of the Market. If there are two
or more of the same kind of produce, then stallholders to work instead
on developing differences in the produce or explore ways to add value
and differentiate the produce.
• The
Market recognises that the consumers maintain the right of choice,
whilst enabling each stallholder to determine their own price.
• End-of-trading-day
discounting is not permitted.
• Stallholders
should ensure their measuring scales are accurately calibrated, as
per standard trading regulations.
Stallholders
Responsibility
• Suitable
product liability coverage must be obtained prior to trading. A copy
of the current premium must be supplied to the Market Coordinators.
It is the responsibility of the stallholder to ensure a renewal copy
is forwarded to the Market Coordinators annually.
• All
stallholders are expected to maintain the Market’s standards
of freshness and high quality and must comply with appropriate regulations
(eg product labelling, health & safety) and acquire any necessary
licenses (eg for wine sales or meat) or permits for selling or producing
their products. Copies of these licenses must be given to the Market
Coordinators prior to selling at the Market.
• Access
to the site is from the time stated in the Eyre Peninsula Field
Days (EPFD) prospectus. Stallholders are required to have their
site ready, with all exhibits available for display by time stated
in the EPFD prospectus. Stalls can be dismantled from 4 pm 14 August
2008 at the time determined by the EPFD prospectus and not before.
• Stalls
must be open to view and properly staffed by a competent representative
during opening hours as determined in the EPFD prospectus.
• Stallholders
are responsible for the decoration and the maintenance of their site
in a clean and tidy condition at all times.
Who
may sell?
• Only
the producer, his/her family or employees directly involved in production
will be permitted to sell the produce.
• If
a stallholder is unable to attend a particular market, a representative
may be nominated to sell items on the original stallholder’s
behalf for that period of time only. The Market Coordinators must
be informed in writing (post, email or fax) prior to the commencement
of the market day.
DISCLAIMER
OF LIABILITY
• The
organiser will not be liable for any loss or damage to the property
of the stallholders due to fire, robbery, accidents or any cause whatsoever
that may arise from use and occupancy of the site.
• The
organiser assumes no liability for any damages or losses resulting
from or relating to the failure of the stallholder to comply with
the provisions of this agreement.
COMPLAINTS
Bring to the
attention of the Market Coordinators.
OTHER
INFORMATION
• Stall
distribution will be at the discretion of the Market Coordinators
in line with the best interests of the EP Farmers Market. A plan of
the set-up will be kept by the Market Coordinators and will be on
display at the EP Farmers Market information stall on market days.
• Sharing
of the site space may be permitted with prior agreement of the Market
Coordinators.
• The
Market Coordinators will work to ensure that a broad range of produce
is available, and that the market is not dominated by one particular
type and/or variety of product. For example, the MC’s may not
allow more than three stallholders selling strawberries unless they
are different varieties or organically grown.
• The
EP Farmers Market reserves the right at any time to alter the size,
shape and position of floor plans as may be necessary for the best
interests and legal requirements of the market.
The EP Farmers
Market is working towards a plastic-free market (within the parameters
of food packaging laws) and encourages all producers to use natural
materials where possible. Hessian bags will be sold displaying the
EP Farmers Market logo.
